W.Va. family is suing the city, fire department over death

WEST VALLEY CITY, Utah — Family members of a woman who died after having a heart attack are suing West Valley City and the West Valley Fire Department, accusing them of failing to take the woman to a hospital after her son called for help.

According to documents filed in 3rd District Court on Thursday, Sandra Barnard’s son called for emergency help last October when she told him of severe arm and chest pain, tightness and tingling. Paramedics responded and believed Barnard, 50, was suffering from a panic attack, so they did not take her to a hospital.

Within minutes, Barnard’s son drove her to Pioneer Valley Hospital, according to the documents. Two days later, Barnard died, leaving behind her husband, four children and five grandchildren.

Barnard’s estate, represented by her husband Scott Barnard, is asking West Valley City for at least $10,000 -- the cost of medical expenses -- and attorney fees, as well as other damages to be determined. The Barnards have requested a jury trial.

The family’s lawsuit alleges negligence, failure to obtain informed consent and intentional infliction of emotional distress. City officials were unavailable for comment.
