Texas dialysis patient’s family sues non-emergency transport agency for wrongful death

The lawsuit states that Vernon Roberson, 67, was left outside at the wrong address on a 97-degree day in Houston

HOUSTON — The family of a Houston man who died in October 2020 is suing a non-emergency transport company for wrongful death, KPRC reported.

The Rightway Medical Transportation and employee Dexter Brown, a driver, are named in the lawsuit.

The suit states that the driver left wheelchair-bound Vernon Roberson, 67, at the wrong address on Aug. 19, 2000. Roberson was outside on a driveway two doors down from his home for hours when the temperature was 97 degrees, said Attorney Randy Sorrels. There was no one there to receive him.

Roberson was unable to communicate, ABC 13 reported.

A neighbor saw Roberson, called 911, and said the man was unconscious.

Rightway transported Roberson to his regularly scheduled dialysis appointments. Brown was assigned to pick up and drop off Roberson at his home that day.

“For someone whose reserves were so depleted, they took a significant toll on his organs, and his organs just never recovered,” Sorrels told ABC 13.

The owner of Rightway Medical Transportation told ABC 13 that no patients have died on her watch.
