Neb. bill would prevent charges in some overdoses

OMAHA, Neb. — For a person suffering from a drug overdose, the decision to seek possibly lifesaving medical care could be trumped by the threat of criminal charges.

But one Nebraska lawmaker wants to alleviate those fears.

Sen. Rich Pahls of Omaha has introduced a bill (LB383) that would prevent users of illegal drugs who go to emergency rooms or seek other kinds of medical help for overdoses from being charged with drug possession. The goal is to encourage people to seek help by removing the fear of prosecution.
