DUNKIRK, N.Y. — The family of a man who died in an ambulance crash is filing a lawsuit against the ambulance company and driver.
Observer Today reported that the widow and son of Arthur McArthur are accusing driver Robin Morey, as well as EmergyCare, of negligence and recklessness. The crash occurred on Feb. 14, 2017 while Morey was transporting McArthur to a nursing and rehabilitation center. Morey left the roadway, entered a ditch and struck a culvert.
McArthur was pronounced dead at the scene; Morey and an EMT in the ambulance were treated for non-life threatening injuries. Morey later told police she had fallen asleep at the wheel.
However, EmergyCare officials said Morey suffered a “sudden and unanticipated” medical emergency that caused her to veer off the road, according to the report.
