Court: Man’s estate can’t sue over ambulance crash

The man was suffering a heart attack when an ambulance he was in crashed, throwing him into a ditch; he died from his injuries

MADISON, Wis. — A state appeals court decided the estate of a man who died in an ambulance crash while being transported to the hospital can’t sue.

The Wisconsin Law Journal reported an ambulance was called to transport Clarence Collis, who was suffering a heart attack, to the hospital. The ambulance crashed en route. Collis was later pronounced dead.

In 2014, Collis’ estate filed a wrongful death lawsuit. Last year, a judge ruled the estate failed to give notice of the claim. The estate said it did not need to give notice of the claim because the rescue squad was not a government entity.

On Thursday, officials ruled the squad is a municipality and that the claim required notice.
