VIRGINIA BEACH — An emergency medical services captain is back to facing a felony charge of nonfatally strangling his girlfriend.

A General District Court judge dismissed that charge earlier this month, along with the assault charges David Charles Baust, 48, and Mary Elizabeth Genovese-Brown filed against each other in February. The allegations stemmed from a violent breakup fight, they said in court.

But the commonwealth’s attorney is continuing to prosecute Baust. A grand jury Monday returned an indictment on the strangulation charge, and it will be tried in Circuit Court.

Baust has been removed from field duty while the city evaluates the charge, EMS spokesman Ed Brazle said. An EMS employee for 28 years, he has been a captain since 2007, supervising seven paramedics.
