OGDEN, Utah — A new trial date for a former EMT accused of the negligent homicide of an elderly woman has been set, nearly three years after the incident.
Sean Stephens-Applonie appeared in the 2nd District Court of Ogden Wednesday to waive his right to a speedy trial and to ask for a new trial date. Stephens-Applonie is charged with class A misdemeanor negligent homicide.
This is the second time a jury trial has been canceled and rescheduled.
On July 6, 2012, the North Davis Fire District ambulance driver was transporting a patient when the ambulance collided with another vehicle at U.S. 89 and Sunset Drive in South Ogden. Arline H. Logan, 88, was killed in the crash and several others were injured.
Authorities concluded that Stephens-Applonie had his lights and sirens active and there was no indication of driving under the influence, but they allege that he recklessly ran a red light.
The case has had multiple delays due to arguments over expert witnesses who may testify in trial. Attorneys have stated that ambulances are permitted to run red lights in emergencies, but only if they slow down, are clearly seen and proceed cautiously through. Prosecutors allege that Stephens-Applonie didn’t slow down, not giving the driver of the other vehicle enough time to see him and stop.
After he was charged, Stephens-Applonie was permitted to stay on duty and currently works as an EMT firefighter for West Jordan City; however, he is prohibited from driving an ambulance until the case is resolved.
The trial was originally slated to begin next week, but Stephens-Applonie’s defense requested more time to prepare. The new trial is scheduled to begin June 25.
